What is Duty of Care?

All companies have a responsibility for staff safety and that of the general public. With ever more legislation in place those responsible can be held legally accountable for a failure to exercise an effective Duty of Care.

Why should we do anything?

Ignorance or lack of action is no defence in law. Additionally there are both legal and moral obligations on us all to ensure colleague safety in everything we do. There are also sound economic reasons for being pro-active as any incident, apart from the human cost, is likely to involve additional legal costs, insurance premiums and disruption.

What should I do?

In the case of vehicles, a Duty of Care may be classified as ensuring drivers are properly licensed and their vehicles in good mechanical condition. Additionally, management needs to know which drivers pose the greatest risk to themselves and others.
